Virginia Law on Court Record Access

Public access to Spotsylvania court dockets is grounded in two key statutes. The Virginia Freedom of Information Act (§ 2.2-3700) establishes that all public records are open unless a specific exemption applies. This is a broad presumption of openness. For court records specifically, § 17.1-208 requires the Clerk to allow inspection by any person during office hours without requiring a stated purpose.

The docket itself is governed by Title 8.01 of the Code of Virginia, which covers civil procedure. Chapter 10 of Title 8.01 (§§ 8.01-331 through 8.01-335) sets out how courts maintain their dockets and what information must be recorded for each case event. The full framework for courts of record, including clerk duties, is in Title 17.1.
