Virginia Law on Court Record Access

Two statutes form the core of Virginia's public access framework for court dockets. The Virginia Freedom of Information Act (§ 2.2-3700) creates a broad presumption that public records are open unless a specific exemption applies. For court records, § 17.1-208 requires the Circuit Court Clerk to allow inspection by any person during regular hours without requiring a reason.

The rules on how courts maintain their dockets and make them accessible are in Title 8.01 of the Code of Virginia, Chapter 10, covering §§ 8.01-331 through 8.01-335. The broader statutory framework for courts of record, clerk duties, and record preservation is in Title 17.1. Together, these provisions ensure that Sussex County docket records stay open and accessible over time.
